Welcome to Buddy the Ball! By accessing or using buddytheball.net, you agree to the following Terms & Conditions. Please review them before using our website, purchasing merchandise, or engaging with our digital content.

1. About Buddy the Ball

Buddy the Ball LLC provides youth sports programming, educational entertainment, digital media, and branded merchandise designed to inspire active, healthy lifestyles.

These Terms & Conditions apply to our website, online store, and digital content.

Class Registrations: Enrollment, tuition, cancellations, refunds, attendance, and other class-related policies are governed by the separate agreements presented through our registration and payment platform, Jackrabbit Classes. Those agreements control where they specifically apply to class participation and purchases.

2. Intellectual Property

All Buddy the Ball branding, characters, logos, illustrations, artwork, videos, curriculum materials, written content, and original designs are owned by Buddy the Ball LLC or used with appropriate permission.

You may not reproduce, modify, distribute, sell, or commercially use our intellectual property without prior written authorization.

Personal, noncommercial sharing of our publicly available content is welcome when proper credit is provided and the content is not materially altered or misrepresented.

3. Videos, YouTube & Digital Content

Buddy the Ball creates family-friendly entertainment, educational videos, athletic activities, and original animated programming.

Our publicly available videos may be shared using official links or platform-supported embedding features, subject to applicable platform terms.

Downloading, reuploading, editing, redistributing, or commercially exploiting our videos without permission is prohibited, except where permitted by law.

Content featuring children, families, coaches, or other participants may not be extracted, altered, or repurposed in ways that violate privacy, publicity, or other applicable rights.

Participation in activities demonstrated in our videos is voluntary. Parents and guardians are responsible for providing appropriate supervision and determining whether activities are suitable for their children.

4. Online Merchandise & Purchases

Our online store offers Buddy the Ball branded merchandise and related products.

Some merchandise is produced on demand or fulfilled through third-party suppliers. As a result, production times, shipping locations, and delivery schedules may vary.

We strive to provide accurate product descriptions, pricing, and availability. However, product colors and appearances may vary slightly depending on screen settings and manufacturing processes.

We reserve the right to correct errors, update product information, or cancel orders when necessary. Any payment collected for an order we cancel will be refunded.

5. Returns, Refunds & Exchanges

Many Buddy the Ball products are printed or manufactured specifically after an order is placed.

Print-on-demand and made-to-order merchandise is generally not eligible for returns or exchanges due to incorrect size selection, change of mind, or personal preference.

If an item arrives damaged, defective, or incorrect, please contact us at contact@buddytheball.net with your order number and photographs of the issue.

We will review the situation and arrange an appropriate resolution, which may include a replacement or refund.

Other merchandise may be eligible for returns depending on the product and fulfillment provider.

6. Website Use & Third-Party Services

You agree to use our website lawfully and not interfere with its functionality, security, or operation.

Our website may contain links to third-party services, including YouTube, Shopify, and Jackrabbit Classes. These platforms maintain their own terms, privacy policies, and operating procedures.

Buddy the Ball LLC is not responsible for independently operated third-party websites or services, except as required by applicable law.

7. Disclaimer & Limitation of Liability

Our website and digital content are provided for general informational, educational, and entertainment purposes.

We make reasonable efforts to maintain accurate and accessible content but cannot guarantee uninterrupted availability or error-free operation.

To the extent permitted by applicable law, Buddy the Ball LLC is not liable for indirect, incidental, or consequential damages arising from use of our website or digital content.

Nothing in these terms excludes liability that cannot legally be excluded.

8. Privacy

We respect the privacy of our website visitors, customers, and families.

Information collected through our website and online store is handled according to our separate Privacy Policy.

9. Updates to These Terms

Buddy the Ball LLC may update these Terms & Conditions periodically to reflect changes in our services, business practices, or legal requirements.

10. Governing Law & Contact

These Terms & Conditions are governed by the laws of the State of Nevada, United States, except where applicable law requires otherwise.

 

 

11. DATA PRACTICES

Buddy the Ball discloses the collection of any personal and sensitive information from children in our app, including through APIs and SDKs called or used in your app.

Sensitive information from children includes, but is not limited to, authentication information, microphone and camera sensor data, device data, Android ID, and ad usage data.

The Buddy the Ball App follows these data practices:

Apps that solely target children must not transmit Android advertising identifier (AAID), SIM Serial, Build Serial, BSSID, MAC, SSID, IMEI, and/or IMSI. These apps may not request location permission, or collect, use, and transmit precise location.

Apps that target both children and older audiences must not transmit AAID, SIM Serial, Build Serial, BSSID, MAC, SSID, IMEI, and/or IMSI from children or users of unknown age.

Device phone number must not be requested from TelephonyManager of the Android API.

The Buddy the Ball App only uses the Companion Device Manager (CDM) when requesting Bluetooth, unless our App is only targeting device Operating System (OS) versions that are not compatible with CDM.

 

User Data

The Buddy the Ball App is transparent in how we handle user data (for example, information collected from or about a user, including device information). That means disclosing the access, collection, use, handling, and sharing of user data from your app, and limiting the use of the data to the policy compliant purposes disclosed. Please note we are aware that any handling of personal and sensitive user data is also subject to additional requirements in the "Personal and Sensitive User Data" section below. This follows Google Play requirements that are in addition to any requirements prescribed by applicable privacy and data protection laws.

If we include third party code (for example, an SDK) in our app, we ensure that the third party code used in our app, and that third party’s practices with respect to user data from our app, are compliant with Google Play Developer Program policies, which include use and disclosure requirements. For example, we ensure that our SDK providers do not sell personal and sensitive user data from your app. This requirement applies regardless of whether user data is transferred after being sent to a server, or by embedding third-party code in the Buddy the Ball App.
