CONTENT

The Buddy the Ball App content is appropriate for Everyone, and every age, especially parents and their children, ages 2-years-old to 8-years-old.

The Buddy the Ball App complies with Google Play Families policy requirements, including the requirement to use only Families Self-Certified Ads SDKs to serve ads to children and users of unknown age.

 

FUNCTIONALITY

The primary purpose of the Buddy the Ball App is to connect Parents of children/students with Buddy the Ball Coaches. Additionally we this app helps to provide pictures and other useful information to parents of enrolled students in Buddy’s Tennis Club pertaining to the Club or Class. This App does not drive traffic to other websites as a primary purpose, and not without permission of the website owner.

 

GOOGLE PLAY REVIEWS

The Buddy the Ball App requires a login or some other form of authentication to access so we allow Google to test credentials and any instructions necessary to validate all functionality within our App.

The Buddy the Ball App Privacy Policy is listed in the link above, printed on our official website buddytheball.net, in the App itself, and has been submitted to the Google Play store. The label is clear. This is publicly accessible

 

ADS

If the Buddy the Ball App displays ads to children or to users of unknown age, we only use ads SDKs versions that have self-certified compliance with Google Play Families policies as part of the Families Self-Certified Ads SDK Program. This App complies with the following requirements to those users:

Only use Families Self-Certified Ads SDKs to display ads.

Ensure ads do not involve interest-based advertising or remarketing.

Ensure ads present content that is appropriate for children.

Ensure ads follow the Families ad format requirements.

Ensure compliance with all applicable legal regulations and industry standards relating to advertising to children.

 

DATA PRACTICES

Buddy the Ball discloses the collection of any personal and sensitive information from children in our app, including through APIs and SDKs called or used in your app.

Sensitive information from children includes, but is not limited to, authentication information, microphone and camera sensor data, device data, Android ID, and ad usage data.

The Buddy the Ball App follows these data practices:

Apps that solely target children must not transmit Android advertising identifier (AAID), SIM Serial, Build Serial, BSSID, MAC, SSID, IMEI, and/or IMSI. These apps may not request location permission, or collect, use, and transmit precise location.

Apps that target both children and older audiences must not transmit AAID, SIM Serial, Build Serial, BSSID, MAC, SSID, IMEI, and/or IMSI from children or users of unknown age.

Device phone number must not be requested from TelephonyManager of the Android API.

The Buddy the Ball App only uses the Companion Device Manager (CDM) when requesting Bluetooth, unless our App is only targeting device Operating System (OS) versions that are not compatible with CDM.

 

User Data

The Buddy the Ball App is transparent in how we handle user data (for example, information collected from or about a user, including device information). That means disclosing the access, collection, use, handling, and sharing of user data from your app, and limiting the use of the data to the policy compliant purposes disclosed. Please note we are aware that any handling of personal and sensitive user data is also subject to additional requirements in the "Personal and Sensitive User Data" section below. This follows Google Play requirements that are in addition to any requirements prescribed by applicable privacy and data protection laws.

If we include third party code (for example, an SDK) in our app, we ensure that the third party code used in our app, and that third party’s practices with respect to user data from our app, are compliant with Google Play Developer Program policies, which include use and disclosure requirements. For example, we ensure that our SDK providers do not sell personal and sensitive user data from your app. This requirement applies regardless of whether user data is transferred after being sent to a server, or by embedding third-party code in the Buddy the Ball App.

 

APIs and SDKs

We ensure that the Buddy the Ball App properly implements any APIs and SDKs.

We are aware that Apps that solely target children must not contain any APIs or SDKs that are not approved for use in primarily child-directed services.

We are aware that Apps that target both children and older audiences must not implement APIs or SDKs that are not approved for use in child-directed services unless they are used behind a neutral-age screen or implemented in a way that does not result in the collection of data from children.

We are aware that Apps that target both children and older audiences must not require users to sign-in or access app content through an API or SDK that is not approved for use in child-directed services.

 Neutral age screen

If needed for children, we use a neutral age screen, which is a mechanism to verify a user's age in a way that doesn't encourage them to falsify their age and gain access to areas of your app that aren't designed for children, for example, an age gate. An example of this would be a system that asks users to freely enter their month, day, and year of birth. An incorrect setup of a neutral age screen would be presetting the birth date to the required age (for example, 13 years old) or indicating that a certain age is required to access areas of the app. Additional guidance on age screens may be found on the FTC website.

 

SOCIAL APP

The Buddy the Ball App is not primarily, but can be considered a social app, which is an app where the main focus is to enable users to share freeform content or communicate with large groups of people. Some examples of freeform content include drawings, photos, videos, or user-written messages in chat or forums.

That being stated we provide an in-app reminder to be safe online that advises of the real-world risk of online interaction before allowing child users to exchange freeform media or information.

We also require adult action before allowing child users to exchange personal information. For the most part there is no exchange of personal information.

The Buddy the Ball App doesn’t target children in any sense in a chat style.

 

 SOCIAL FEATURES

We ensure our in-app experience is safe and appropriate for children.

We provide an in-app reminder to be safe online and to be aware of the real world risk of online interaction before allowing child users to exchange freeform media or information.

We provide a method for adults to manage social features for child users, including, but not limited to, enabling/disabling the social feature or selecting different levels of functionality.

 We request adult action before enabling features that allow children to exchange personal information.

We are aware that adult action means a mechanism to verify that the user is not a child and doesn’t encourage children to falsify their age to gain access to areas of your app that are designed for adults. Such mechanisms include an adult PIN, password, birthdate, email verification, photo ID, credit card, or SSN.

 

 LEGAL COMPLIANCE

We ensure that the Buddy the Ball App, including any APIs or SDKs that our app calls or uses, is compliant with the U.S. Children's Online Privacy and Protection Act (COPPA), E.U. General Data Protection Regulation (GDPR), and any other applicable laws or regulations.

The Children’s Online Privacy Protection Act (COPPA) gives parents control over what information websites can collect from their kids. 1. Introduction

These terms and conditions govern your use of the Buddy's Tennis Club service (the "Service"). The Service is offered by Buddy the Ball, located at 1651 S. Buffalo Dr. Las Vegas, NV 89117. By using the Service, you agree to be bound by these terms and conditions.

2. Service Description

The Service provides introductory tennis classes for preschool and grade school children ages (roughly) 3-10 years old under the name Buddy's Tennis Club. Classes are weekly and charged at a monthly rate of $89 per month, billed automatically at the beginning of the month on a subscription basis.

3. Enrollment and Cancellation

Enrollment in the Service is for a minimum of 8 weeks and is a commitment for the entire two months of payment. Parents may cancel their child's enrollment at any time by emailing their request to ryan.greer@buddytheball.net. Cancellations will take effect at the end of the current month, as long as the two month commitment has been met, and no refunds will be provided for the remaining portion of the month.  

4. Payments

Payments for the Service are made on a monthly basis and are automatically billed to the payment method on file. If a payment fails, the parent will be responsible for supplying a valid form of credit/debit card for payment. Customers are responsible for all past due payments in full. 

5. Refunds and Credits

Refunds and credits will not be provided for any portion of the Service, including if a parent cancels their child's enrollment mid-month.

6. Limitation of Liability

Buddy the Ball will not be liable for any damages or injury that may occur during the use of the Service. Parents must ensure that their child is physically fit to participate in the classes and assume all risk of injury.

7. Photo Disclaimer

DISCLAIMER: By enrolling your child in Buddy's Tennis Club, you acknowledge that your child's photo may be taken during class and may be used on Buddy the Ball's website or marketing materials. Buddy the Ball will make reasonable efforts to protect your child's privacy by not using your child's name or any other identifying information in association with the photo. However, Buddy the Ball cannot be held responsible for any third-party use of the photo beyond our control. If you have any concerns or objections regarding the use of your child's photo, please contact us at ryan.greer@buddytheball.net.

8. Changes to Terms and Conditions

Buddy the Ball reserves the right to make changes to these terms and conditions at any time. Continued use of the Service after changes have been made constitutes acceptance of the revised terms and conditions.

By using the Service, you agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, you should not use the Service.
